1. Acceptance of Terms

By accessing, registering for, or using the services provided by Tokin ("Tokin," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Platform. These terms apply to all visitors, users, and others who access our API or dashboard.

2. Description of Service

Tokin operates a high-performance, unified API gateway that provides streamlined access to various large language models (LLMs) and upstream AI providers. We offer usage tracking, load balancing, API key management, and proxy routing services to our users. The specific models, throughput limits, and features available are subject to change without notice based on upstream provider availability and platform load.

3. Account Registration and Security

You must be at least 18 years old to create an account and use the Services.
You are responsible for maintaining the confidentiality of your account credentials, including all generated API keys.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Tokin will not be liable for any loss or damage arising from your failure to protect your API keys.

4. Acceptable Use Policy

You agree not to use the Services to:

Violate any applicable local, state, national, or international laws or regulations.
Bypass, circumvent, or attempt to bypass any rate limits, bans, or security measures enforced by Tokin or our upstream providers.
Generate, transmit, or promote illegal content, non-consensual explicit material, malware, or spam.
Interfere with or disrupt the integrity or performance of the Platform.
Resell, sublicense, or distribute the API keys without explicit written authorization from Tokin.

Violation of these rules may result in immediate suspension or permanent termination of your account and forfeiture of any remaining prepaid credits.

5. Payments, Credits, and Crypto

Tokin operates on a prepaid credits model. Users must fund their accounts prior to making API requests.

Cryptocurrency Payments: We process top-ups using cryptocurrency via third-party providers (e.g., Coinbase Commerce, Plisio). You acknowledge that blockchain transactions are irreversible. Send funds only on the specified networks; unsupported network transfers will result in the permanent loss of funds, which Tokin cannot recover or credit.
Usage Deductions: Credits are automatically deducted from your balance as you consume API requests based on real-time pricing grids.
Refunds: Due to the nature of computational resources and cryptocurrency processing, all credit purchases are final and non-refundable unless required by applicable law.

6. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without notice. While we strive for maximum uptime, Tokin does not guarantee uninterrupted or error-free operation of the API gateway. Upstream provider outages are beyond our control and may affect the availability of specific models.

7. Intellectual Property

The Platform, its original content, features, and functionality are owned by Tokin and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Your prompts, inputs, and the resulting outputs are subject to the intellectual property terms of the respective upstream LLM providers you route requests to.

8. Disclaimer of Warranties and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TOKIN MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL TOKIN, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
